Many types of charges are not eligible for expungement under Rsmo 610.140.

Dangerous felonies are not eligible for expungement.

Dangerous felonies include the following. Here is a list of many of the dangerous felonies that are not eligible for expungement.

  • All sex crimes requiring registration as a sex offender;
  • Kidnapping in the 1st degree;
  • Murder in the 2nd degree;
  • Assault of a law enforcement officer in the 1st degree;
  • Elder abuse in the 1st degree;
  • Robbery in the 1st degree;
  • Statutory rape in the 1st degree;
  • Statutory sodomy in the 1st degree;
  • Any offense where death is an element of the offense, including manslaughter
